RERA Questions Answered
Can I get a full refund from my builder under RERA?
Yes. Under Section 18 of the RERA Act, if the builder fails to hand over possession by the agreed date, you are entitled to claim a full refund of all amounts paid along with interest at the rate prescribed by the Delhi government. The Delhi RERA Authority has consistently granted refund orders in cases of prolonged delay. You do not need to prove fault beyond showing that the possession date has passed.
What is REAT and how do I file an appeal there?
REAT stands for the Real Estate Appellate Tribunal. It hears appeals against orders of the Delhi RERA Authority. The appeal must be filed within 60 days of the RERA order. A RERA lawyer in Delhi prepares the grounds of appeal, assembles the record and represents you at Tribunal hearings. REAT can modify, set aside or confirm RERA Authority orders.
How much compensation can I claim for delayed possession?
You can claim interest at the prescribed rate for every month of delay running from the agreed possession date until actual delivery or refund. Additionally, the RERA Authority can award compensation for any loss you suffered due to the delay, including rent paid for alternate accommodation. In cases of intentional default, the builder can also face penalties and project registration cancellation.
Can RERA help if my builder has been admitted into insolvency under IBC?
Once a builder is admitted into insolvency before the NCLT, RERA proceedings are generally stayed under Section 14 of the IBC. However, as a homebuyer you are a financial creditor and can file a claim before the Resolution Professional and participate in the Committee of Creditors. The Supreme Court has upheld homebuyer rights in IBC proceedings. RSLC advises on both RERA and IBC remedies together.
