What is the difference between a writ petition and a first appeal at the Delhi High Court?
A writ petition under Article 226 is an original jurisdiction remedy that challenges the action of a government body, statutory authority or public official on grounds of illegality, irrationality or breach of natural justice. No prior lower court proceeding is required. A first appeal is filed against a decree already passed by a district court, asking the Delhi High Court to re-examine the factual and legal findings and set aside or modify the decree. Both are different tracks, filed in different registries of the High Court.
